1. Estimate Disclaimer and Scope of Work
This estimate is provided as a Not-to-Exceed (NTE) cost projection based solely upon the initially agreed-upon scope of work for services performed by Skyward Solutions Photography.
Any modifications, additions, or deviations from the original scope of work — including, but not limited to, additional flight time, reshoots, expanded coverage areas, enhanced editing, additional deliverables, specialty media requests, or revised project requirements — may require a revised estimate and prior written approval from all parties before additional services are performed.
This estimate applies only to the services specifically outlined and does not include any work, materials, or operational costs not expressly identified within the approved scope.
2. Excluded Costs and Additional Expenses
Unless otherwise agreed to in writing, this estimate excludes costs associated with consumable items, equipment maintenance, repairs, travel-related expenses outside the agreed service area, and extraordinary operational expenses, including but not limited to:
- Fuel and transportation expenses
- Equipment wear and tear
- Drone maintenance or repair
- Battery replacement
- Software licensing or specialty editing software
- Damage resulting from misuse, unsafe operating conditions, severe weather, third-party interference, or circumstances beyond reasonable operational control
Responsibility for such costs shall remain with the client when directly caused by project requirements, venue restrictions, client requests, or site-specific operational needs, unless otherwise agreed upon in writing.
3. Specialized Events, Permits, and Site Requirements
Depending on the project location, venue, or event requirements, this estimate may include fees or services associated with:
- Property access permits
- FAA-authorized restricted airspace approvals or flight authorizations
- Event coordination services
- Security personnel or access escorts
- Venue-specific insurance requirements
- Graphic design, advanced retouching, or specialty editing services
- Additional staffing or operational accommodations required by the venue or event organizer
Any additional required services, approvals, or expenses necessary to complete the project shall be billed separately upon client approval.
4. Operational Safety and Scheduling
Skyward Solutions Photography reserves the right to suspend, postpone, reschedule, or cancel drone or photography operations due to unsafe weather conditions, FAA restrictions, airspace limitations, safety concerns, equipment issues, venue restrictions, or any circumstances that may compromise operational safety, legal compliance, or project quality.
Reasonable efforts will be made to reschedule services at a mutually agreed-upon time.
5. Photography and Videography Copyrights / Media Usage
All photographs, videos, drone footage, edited media, and related content created by Skyward Solutions Photography shall remain the intellectual property of Skyward Solutions Photography unless otherwise agreed to in writing.
Skyward Solutions Photography reserves the right to use any photographs, videos, or media captured during services for promotional, marketing, portfolio, advertising, business development, website, social media, educational, or other lawful business-related purposes unless otherwise prohibited through a signed written agreement prior to service.
Clients may not reproduce, resell, alter, or commercially distribute media for third-party commercial purposes without prior written authorization, unless usage rights have been expressly granted in writing.
6. Acceptance of Terms
Approval of this estimate, payment of deposit, scheduling of services, or authorization to proceed shall constitute acknowledgment and acceptance of these Terms and Conditions.
